Finding Positive Resolutions in Divorce

While we attempt to minimize conflict whenever possible and utilize creative and effective solutions in negotiation and mediation, we also understand that litigation is often necessary and will protect your rights in cases where an amicable solution is not possible.

Alternative dispute resolution refers to the different ways that parties in a divorce can settle their differences outside of a courtroom. By using an alternative method to achieve an agreement about the details of a divorce, couples are usually able to save money and time and can resolve their divorce in a more peaceful, accommodating manner. These common methods include:

· Mediation:
In mediation, couples work with their attorneys and a trained mediator to reach an agreement on contested issues in the divorce, such as alimony, property division, child custody and visitation, parenting plans and child support.

· Arbitration:
In arbitration, the parties agree to present their cases to an arbitrator, instead of a judge, who will make final decisions regarding the issues in a divorce. While this method is more like court than mediation, it is generally still cheaper and quicker than going to court.

· Collaborative Divorce:
The relatively new method of collaborative law is a process that requires compromise. Both parties commit from the beginning of the case to resolve their disputes by negotiation instead of going to court. If either of the parties to the divorce decides that the collaborative process is not working, both parties must find new attorneys to represent them in court.

Whether your case ultimately ends up in mediation, arbitration, collaborative divorce, or trial, you need a lawyer by your side who will provide the experienced representation and personal service that you deserve.
